Last Atlantis Cleared of Interactive Brokers Allegations

in FINRA Arbitration

Last Atlantis Capital Management is very pleased to announce the positive resolution of its legal dispute with Interactive Brokers. In May 2007 Interactive Brokers accused LACM of various wrongdoings including illegal trading and common law fraud and proceeded to file an arbitration claim with FINRA in August of 2007. IB’s actions also prompted the NFA to investigate Last Atlantis, and without verifying any of the facts, the NFA filed an MRA against LACM containing strikingly similar language to the IB allegations filed in the arbitration.

Throughout this ordeal Last Atlantis refused to buckle under the pressure of Interactive Broker’s vast financial resources and legal attack. We continued to defend the interests of our investors by mounting a legal defense that took two years and millions of dollars with the able help of our legal team, led by Tony Valiulis and Ed Shapiro of the Chicago firm, Much Shelist. We would like to extend our sincere gratitude to Mr. Valiulis, Mr. Shapiro, Ms. Andrea Forsyth and Much Shelist for the outstanding work they did in this matter and their dedication in the face of Interactive Brokers’ overwhelming resources and relentless assault.  

Late last week, the FINRA arbitration panel submitted their final ruling and we are pleased to say that all of Interactive Brokers’ claims have been dismissed and Last Atlantis has been cleared of all charges.

We always contended that IB’s claims were completely baseless, and we are pleased that the FINRA Panel agrees with us. This award vindicated Last Atlantis on every single issue and is gratifying, but nonetheless LACM will not rest until we determine that everything has been done to protect all our investors’ interests. Accordingly, we intend to pursue any additional legal recourse that may be available to Last Atlantis and its investors, either in or outside of the FINRA arbitration process.

We have used our down time during the legal battle with IB to research and test the next phase of our proprietary strategy that has in the past delivered consistent, high risk-adjusted returns.

Now that this matter is behind us and our trading strategy has been vindicated, we are moving forward and are announcing the launch of a new fund which is available to investors starting November 1, 2009. The new fund is a combination of our traditional strategies and the implementation of additional phases of our core strategy. We believe the new fund will produce similar returns to those of the original Share Class “O” fund.
